Job Description The Office of Equity and Inclusion (OEI) is primarily responsible for investigating or otherwise addressing complaints of discrimination, harassment, sexual misconduct, retaliation and nepotism. The OEI provides educational programming on these topics and other equity and diversity-related topics.

The Director of OEI (Director) serves as senior administrator for Tennessee State University. Organizationally, the Director reports to the Vice President for Business and Finance, and works with and reports on specified matters to the President and the University Counsel. The Director also supervises the Office of Disability Services, and manages OEI staff.

The Director supports and coordinates the University’s compliance with federal and state equal opportunity and equity laws, as well as University policies and guidelines on equal opportunity and equity (e.g., Title VI, Title VII, Title IX, Violence Against Women Act and other related state and federal regulations and TSU policy requirements). The Director also affirms the value of diversity through cultivation of mutual respect, acceptance, and understanding, and provides critical leadership and direction to the campus community to support and enhance the University’s commitment to equity and inclusion.

The Director is responsible for investigating protected class complaints and ensuring effective and efficient management and resolution of complaints, which includes performing the following:
Handle the intake of complaints filed with the OEI and assess appropriate resolution process and procedural protocol. Provide consultation and education to students, faculty, and/or staff on discriminatory practices, equity matters, policies, procedures, and options for resolution of complaint matters.

Investigate OEI complaints of discrimination and harassment filed by students, staff, faculty, or visitors in compliance with federal and state laws, executive orders, and University policies and procedures. Process within specific time constraints investigations, analyses, and report findings and conclusions of complaints filed with the OEI.

Ensure effective, efficient, and thorough investigations while ensuring attention to detail and accuracy regarding facts, relevance, and investigation documentation.

Provide information and assistance to the University Counsel in the University Counsel’s handling of and response to complaints involving outside agencies, including the Equal Employment Opportunity Commission, Office of Civil Rights, and Tennessee Human Rights Commission.

Conduct training sessions and educational programs for students, faculty, and staff on compliance with applicable federal and state equal opportunity laws, TSU policies governing discrimination, harassment, and equity, and the OEI’s complaint procedures.

The Director also serves as the Title IX Coordinator and leads a team of Deputy Title IX Coordinators in ensuring the institution’s compliance with all aspects of Title IX, including conducting training sessions, investigating Title IX related complaints, overseeing investigations by Deputy Title IX Coordinators, and maintaining required Title IX data.

Performs other duties as assigned by the Vice President for Business and Finance.

Minimum Qualifications/Experience Requires a Juris Doctor (J.D.) from an accredited law school or a Master’s degree in HR-related field with employment law knowledge.

Minimum of five years of experience investigating equal opportunity related complaints and conducting training sessions, with at least two years of supervisory experience.

Demonstration of progressive leadership experience.

Excellent writing and analytical skills.

Knowledge of discrimination, harassment, equal opportunity and affirmative action laws, regulations, and guidelines.

Experience developing and delivering training or education on equal opportunity and diversity-related topics.

Experience presenting educational materials to adult learners.

Excellent judgment in complex, nuanced contexts.

Exceptional communication, interpersonal skills as well as emotional intelligence and executive presence.

Ability to manage and work with conflict.

Ability and desire to work actively, collaboratively and creatively as part of a team.

Excellent administration, leadership and supervisory skills.

Preferred Qualifications:
Equal opportunity investigatory experience working at an institution of higher education, governmental agency, or large, complex organization.

Two years experience in conducting investigations involving Title IX matters.

Title IX/sexual misconduct compliance experience.

In-depth knowledge of higher education policy, laws, and trends related to sexual misconduct on college campuses.

(Full-Time), Office of Human Resources; – SALARY – $55,000 – $72,000 per annum.

QUALIFICATIONS: Applicant must have a Master’s Degree in Human Resources Management, Business, Public Administration, or a related field from an accredited institution and ten (10) years of progressive experience addressing EEO and Affirmative Action issues, including investigating employee/applicant complaints of discrimination or workplace harassment, and experience writing and developing Affirmative Action Plans, or have a Juris Doctorate (JD) Degree from an accredited law school, a license to practice law in the State of Mississippi, and five (5) years of experience handling employee relations issues, including discrimination, workplace harassment (age, gender, sexual, race, etc…) and grievance hearings. RESPONSIBILITIES: Receives and investigates inquiries and formal complaints of unlawful discrimination; Responds to complaints from enforcement agencies including but not limited to Department of Labor (DOL), Office of Federal Contract Compliance, Equal Employment Opportunity Commission, Wage and Hour Division, and Department of Justice (ADA); Assists Managers and Supervisors in identifying, resolving, and preventing equal employment opportunity/affirmative action problems; Investigates, compiles, and submits required AAP/EEO statistical reports; Monitors administration of the FMLA, and HIPPA compliance programs to prevent illegal discrimination and to ensure confidentially of private information; Maintain compliance with record keeping requirements; Develops, consults and advises management on the application of regulations and statues, including EEO and other statues, and on the revision of policies, forms, and documents, such as job descriptions, for compliance; Prepares briefs and conducts presentations at hearings, as needed; Assists in review of policies and practices relating to hiring, training, transfer and promotion of minorities, females, and disabled employees; Oversees the University’s Employee Grievance Procedures/Hearings; Performs other duties as required.
